MyMarchant is an online platform that connects vendors and traders to facilitate trade. By accessing or using MyMarchant, you agree to abide by these Terms and Conditions.
MyMarchant collects and uses personal information in accordance with our Privacy Policy, and by using this Platform, you consent to the collection, use, and disclosure of their personal information as described in the Privacy Policy.
We may engage third-party services or share certain data with trusted partners for the purpose of providing and improving its services, but such activities are governed by our Privacy Policy.
Here are definitions of certain key terms mentioned in this document:
- 'Platform' refers to the MyMarchant website, mobile applications, and associated services.
- 'Vendor' refers to a User who lists and sells products on MyMarchant.
- 'Trader' refers to a User who purchases products from Vendors on MyMarchant.
For Vendors
1. To become a vendor on MyMarchant, you must complete the registration process, which involves creating an account and supplying all the necessary information. This information is important for compliance with legal and operational regulations governing our platform.
You are responsible for providing accurate and up-to-date information during the registration process and throughout your use of MyMarchant. And, you acknowledge that we rely on the information provided by you, and any inaccuracies may affect your ability to use our Platform or the trust of other Users.
2. As a vendor, it is important to maintain a professional and respectful approach when communicating with traders. This includes using polite and courteous language, responding promptly to inquiries, and supplying clear and concise information at all times. Effective communication fosters trust and positive relationships between vendors and traders, enhancing the overall trading experience.
The penalty for any vendor flagged for inappropriate communication could range from temporary suspension to permanent removal from the site, and any such penalty is at the discretion of our Conflict Resolution team.
3. Vendors are encouraged to optimize their selling and buying strategies to facilitate successful transactions. This involves accurately representing their products, services, or assets, providing comprehensive details, and ensuring fair and competitive pricing.
4. Maintaining up-to-date rates is important to reflect the current market conditions accurately and prove transparency to Traders. Regularly reviewing and adjusting your rates ensures that Traders always have access to the most relevant and reliable information in order to make informed decisions and reduce the likelihood of unwanted friction.
5. Timely and responsive communication is highly valued on MyMarchant. As such, it is important to promptly address Traders' inquiries, offers, or any other communication they initiate. Responding within a reasonable timeframe demonstrates professionalism, reliability, and respect for Traders' time. Delays in response may result in missed trading opportunities and can negatively impact your reputation as a Vendor.
6. By signing up as a Vendor on MyMarchant, you agree that the platform will act as the primary mediator in the event of any disputes between Vendors andTraders. MyMarchant aims to facilitate fair and equitable resolutions to conflicts, ensuring a positive trading environment for all parties involved. However, should mediation fail to reach a satisfactory resolution, Vendors retain their legal rights to pursue appropriate legal channels.
7. At MyMarchant, we prioritize the integrity of our trading ecosystem and handle complaints diligently. We consider multiple unresolved complaints against a vendor as a serious matter that can compromise trust. Consequently, such cases may lead to a permanent ban from our platform. It is of utmost importance for Vendors to promptly and satisfactorily address and resolve any complaints, thereby fostering a positive trading experience for all users.
For traders:
1. As a Trader on MyMarchant, you must be at least 18 years old and legally able to enter into binding contracts, as you are required to provide accurate information during the registration process and create a user account. Traders are responsible for maintaining the security of their account credentials and should not share them with unauthorized individuals.
2. Traders can browse the listings provided by Vendors and make purchases based on their preferences and needs. Before committing to any transaction, you must carefully review the total cost of the exchange, including any applicable fees or taxes, before confirming their purchase. Once this is confirmed, you can make payments using the available and accepted payment methods provided by the Vendor.
3. Traders should make prompt payments for their purchases and maintain respectful communication with Vendors. It is important for traders to engage in open and transparent communication to address any concerns or inquiries they may have.
The penalty of a contravention of this term, including but not limited too failure to make payment after contracting, unusual delay before processing payment, payment using a wrong payment method, could result in a temporary suspension from our platform and a restitution plan fostered by our Conflict Resolution team if the Vendor so wishes.
4. In the event of a dispute between a Trader and a Vendor, both parties are encouraged to engage in open and respectful communication to reach a resolution. If a dispute arises, both parties may contact MyMarchant's customer support team for assistance and guidance before instituting legal action.
General
1. MyMarchant provides the Platform "as is" without any warranty or representation, express or implied. MyMarchant does not guarantee the accuracy, reliability, or availability of the Platform or its content.
In no event shall MyMarchant be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to the use of the Platform or any transactions conducted through it.
Users agree to indemnify and hold MyMarchant harmless from any claims, damages, liabilities, costs, or expenses arising from their use of the Platform, violation of these Terms and Conditions, or infringement of any third-party rights.
2. All content, trademarks, logos, and intellectual property displayed on MyMarchant are the property of their respective owners. Users agree not to use or reproduce any copyrighted materials without proper authorization.
If users believe that their intellectual property rights have been violated on the Platform, they should promptly notify MyMarchant's customer support team, providing all necessary details for proper investigation and resolution.
3. These Terms and Conditions constitute the entire agreement between users and MyMarchant, superseding any prior agreements. If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. Failure to enforce any provision of these Terms and Conditions shall not be considered a waiver of such provision or any other rights.
